In court, APC aspirant asks for party ticket, dismissal of Oyebanji


A candidate for the post of governor of the Congress of All Progressives (APC) for the 2022 elections in Ekiti State, Kayode Ojo has petitioned a Federal High Court in Abuja to declare that he is the party’s legitimate candidate in the elections.

Biodun Oyebanji was declared the winner of the June 18 gubernatorial election after beating his main challenger and Social Democratic Party candidate Segun Oni.

He had since received the certificate of return as Governor-elect of Ekiti State.

Mr. Oyebanji was elected as the party’s candidate in the January 27 primaries in Ado Ekiti ahead of Mr. Ojo, who came second in the exercise.

Mr Ojo is, however, in court challenging the outcome of the primaries, saying he was the party’s duly elected candidate.

In a complaint number FHC/ABJ/C5/15/2022, and filed by his attorney, Olaniyan Bolanle, Mr. Ojo challenged what he called “gross irregularities” in the gubernatorial primary election. Party APCs.

Joined in the suit are APC, Ekiti, Biodun Oyebanji, Independent National Electoral Commission (INEC), and all the presidents of the electoral commissions/returning officers of local governments, who are known supporters of the second defendants, but who were appointed to lead the primary.

In his prayers, Mr. Ojo questioned the party’s decision to hold the primary election with the use of politicians appointed by the state executive as election committee/returning officers. He said it was an irregularity and a fundamental breach of party guidelines governing the conduct of said party primaries, the electoral law.

He also urged the court to nullify the party’s governor’s primary held on January 27 on the grounds of the constitutional infraction and flagrant violation of the 1999 guidelines and constitution and to order a new primary. by the party.

Another prayer of the plaintiff is the annulment of the improperly and fraudulently recorded votes for Mr Oyebanji in the primary on the grounds that the governor-elect breached the provisions of the CPA constitution and guidelines governing the conduct of primaries. party.

He urged the court to declare him (Kayode Ojo) as the winner of the primary being the candidate with the next highest declared votes.

The plaintiff also sought an injunctive order restraining INEC from recognizing Mr. Oyebanji as the party’s gubernatorial candidate in the 2022 Ekiti State gubernatorial election and restraining him, as well as any other person, authority or government, to become the APC nominee for Ekiti State. gubernatorial election in June 2022.

The case was however transferred to a Federal High Court in Ado-Ekiti before Judge Babs Kuewunmi.

While being introduced into evidence by lead counsel, Alex Izinyon, on Friday, the plaintiff and another witness testified and were cross-examined by the defence.

Although he closed his file, the procedure suffered a setback because the defense did not open his file due to a lack of preparation.

Defense lawyer Kareem Akingbolu then asked for an extension of time for him to file his defence.

Mr Izinyon told the court he opposed the defense request for an extension.

He argued that since the court’s order to release the subpoena was executed on March 21, the defense should have filed its response within 30 days that expired on April 21.

Mr. Izinyon requested the court’s permission to formally respond to the defense’s request for an extension of time.

The case was then adjourned until July 25 for further trial.
